Anti-spam policy

The user, by registering in the Coldy service, accepts the terms of this Anti-SPAM policy.

If the contract contains a reference or link to the Anti-SPAM policy, the terms outlined in it are an integral part of such a contract.

The Anti-SPAM policy may be amended by the Licensor unilaterally at any time. The current version is considered to be the one posted at: https://coldy.ai/ru/anti-spam. The user undertakes to familiarize themselves with all changes and the current edition of the Anti-SPAM policy independently.

1.Terms and definitions

Contract – the contract concluded between the Licensor and the user for granting the User the right to use the Coldy Service under the terms of a simple (non-exclusive) license.

The Coldy Service (Service) – a hardware and software complex designed for creating, sending, and monitoring the results of email mailing to contacts. 

User – a person using the Coldy Service.

Contact Database – aggregated information about contacts, including their personal data. Uploaded by the User to the Coldy Service in XLS, XLSX, XML, CSV format. 

Email message (message) – a text message sent by the User using electronic devices. 

Complaint about spam one of the following events: 

  • notification from a contact about receiving an unwanted message;

  • blocking of the User's email servers and URLs on major internet resources;

  • receipt of an FBL complaint from the mail server.

Applicable law – the legislation of the Russian Federation.

2.General provisions. Requirements for the content of email messages

2.1.User is prohibited from sending email messages that contain:

  • content that may be considered offensive, harmful, misleading, fraudulent, unfair, immoral, obscene, pornographic, overtly sexual, racist, ethnically offensive, threatening, excessively violent, defamatory, containing false information, hate speech, foul language, gambling (including skill games offering cash prizes or other valuables), discrimination, malware, offers for fast and easy income online, offers for quick and easy money, participation in financial pyramids, illegal drug trafficking, weapons, prescription medications or weapons, as well as pursuing other goals prohibited by Applicable law;

  • informational and/or advertising materials that violate the intellectual property rights, other rights of the Licensor and/or third parties, requirements of Applicable law;

  • third-party trademarks or using trademarks, logos when sending email messages to Subscribers, for which the User has no legal grounds;

  • information intended to mislead the Licensor, Subscribers, consumers, and other third parties about their affiliation to any person without such authority;

  • information stating that the mailing is carried out from the Coldy Service;

  • SPAM in any form or manifestation.

3.SPAM is recognized as sending:

  • in which incorrect or distorted contact details of Subscribers are specified;

  • containing false, incorrect, or misleading information in the subject and text of the email message;

  • where an email address is used that does not belong to the domain associated with the User;

  • Sent messages contain personal data of the recipient collected without their consent;

  • The bounce rate exceeds 5%: when sending emails, the bounce rate must be less than 5% in order to ensure high deliverability.

  •  Spam complaints more than 0.1%: the spam complaint rate must be less than 0.1%, i.e., no more than 1 complaint per 1000 sent emails. Upon receiving complaints, it is necessary to respond quickly and take measures to improve sending quality.

  • Unsubscribes: the unsubscribe rate must be less than 1.5%, calculated as the ratio of the number of unsubscribes to the number of initially sent messages.

  • Invalid addresses: the invalid rate (INVALID) must be less than 2%, calculated as the ratio of the number of invalid addresses to the total number of sent emails. Valid addresses can be checked within our service.

  • Getting caught in spam traps and unjustified complaints about abuse: there should be no instances of getting caught in spam traps and unjustified complaints about abuse. This will ensure the sender's reputation is preserved and ensure high deliverability of emails.

4.Preventive measures against SPAM

4.1.Licensor has the right to carry out pre-moderation, both selectively and of all outgoing email messages from the User.

4.2.Licensor, in carrying out pre-moderation of outgoing email messages from the User, uses powerful semi-automated analytical systems for identifying SPAM activity of Users and its immediate termination by blocking the sending function entirely or in part for specific Subscribers. 

4.3.In order to exclude access to the Coldy Service by unscrupulous Users and misuse of the Service, the Licensor has the right to verify the User's declared data both before granting access to the Service and during the User's work in it. 

4.4.Licensor conducts ongoing training and consultations for Users to create effective email outreach campaigns by posting news materials on the Site or providing responses when Users contact Technical support.

4.5.Licensor has the right to block the mailing function in the Coldy Service in accordance with the procedures and conditions provided for in section 5 of the Anti-SPAM policy.

5.Blocking the mailing function in the Coldy Service

5.1.Licensor has the right to block the User's mailing function in the following cases:

  • when the User sends SPAM, the signs of which are indicated in section 3 of the Anti-SPAM policy.

  • when there are suspicions of the User violating the Anti-SPAM policy until the Licensor's doubts are resolved;

  • upon receipt of claims, demands, complaints about spam from Subscribers, FBL, decisions, and demands of government bodies regarding the distribution of SPAM via the Personal account

5.2.Licensor has the right to block the sending function either entirely or partially for a specific contact, immediately and without notifying the User and without applying penalties or other liability measures to the Licensor, including claims for compensation for losses, damages, and lost profits.

5.3.To lift the blockage, the User provides the Licensor with documents confirming the elimination of violations identified by the Licensor or another person, no later than one working day from the moment of blocking, after which the Licensor may lift the block.

5.4.The User agrees that in the event of blocking the mailing function for any reason, refunds by the Licensor are not made, the funds are retained as a penalty. To continue using the Coldy Service, the User must pay the license fee according to the chosen rate based on the Contract.
